Who I am

I am Dr Anthony Howard, a consultant orthopaedic surgeon who provides independent expert medical evidence. I am the controller of the personal information described in this notice, registered with the Information Commissioner's Office (ICO) under number ZB905000. Whose information this covers

Two groups of people: people who contact me or use this website, and people whose information I receive when I am instructed on a case, usually the claimant and others named in the papers.

Enquiries and this website

  • What I holdYour name, email address, organisation, and what you tell me about the enquiry.
  • WhyTo reply, to check for conflicts of interest, and to arrange an instruction.
  • Lawful basisMy legitimate interests in responding to professional enquiries and running my practice (Article 6(1)(f) UK GDPR). Where you are the person instructing me, also to take steps before entering into a contract with you (Article 6(1)(b)).
  • How longEnquiries that do not lead to an instruction are deleted after 12 months.
  • This websiteSets no cookies and uses no analytics or tracking. Fonts are stored on the site itself, so your browser does not contact Google or any other third party to load them. The site is hosted by Cloudflare, Inc., which processes visitors’ IP addresses to deliver the site and protect it from attack. This can take place outside the UK. Cloudflare covers these transfers under the UK Extension to the EU–US Data Privacy Framework or the UK Addendum to the standard contractual clauses, as set out in its data processing addendum.

Information about a case

  • Where it comes fromThe person instructing me (a solicitor, insurer, coroner, or party to a General Medical Council appeal), the medical records and imaging they send, and, if I examine you, what you tell me and what I find.
  • What I holdIdentity and contact details, date of birth, health information (medical records, imaging and examination findings), information about your work, activities and daily life that bears on the injury, and details of the incident and the claim or proceedings.
  • WhyTo prepare an independent expert report, and for related work such as answering written questions, joint discussions with other experts, and giving evidence.
  • Lawful basisMy legitimate interests in providing expert evidence in legal proceedings (Article 6(1)(f)). Health information is special category data; I process it because it is necessary for the establishment, exercise or defence of legal claims, or whenever courts are acting in their judicial capacity (Article 9(2)(f)).
  • Who sees itThe person instructing me; the court, coroner or tribunal; other parties and experts, through the instructing party and in line with the court's directions; my secretary, who works under a duty of confidentiality; the Medical Protection Society, if needed in connection with my indemnity; and the secure email, file transfer and IT services I use, which store data in the UK.
  • Outside the UKI do not send case information outside the UK.
  • How longMedical records and imaging are securely deleted or destroyed when the case concludes, in line with British Orthopaedic Association guidance (May 2024). My report, correspondence and time records are kept securely for six years after the case concludes, then deleted.

I do not sell personal information, and I make no decisions about anyone by automated means.

Your rights

You can ask for a copy of your information, ask me to correct it, and in some circumstances ask me to delete it, restrict how I use it, or transfer it. Some rights may not apply where the information is needed in connection with legal proceedings.

Your right to object

You can object to my using your information on the basis of legitimate interests. I will stop unless I have compelling legitimate grounds that override your interests, or the information is needed to establish, exercise or defend legal claims.

Complaints

If you are unhappy with how I have handled your information, please email me first at info@dranthonyjhoward.com. I will acknowledge your complaint within 30 days and tell you what I have done.
